TERMS AND CONDITIONS

PROMOTER
The Promoter is Silversea Cruises (UK) Ltd with registered office address at Building 7, The Heights, Brooklands, Weybridge, Surrey KT13 OXW, United Kingdom (“Silversea”).

COMPETITION PERIOD
The Competition commences at 00:01hrs GMT+1 on Tuesday 2nd May 2023 and concludes at 23:59hrs GMT+1 on Friday 30th June 2023. Any entries received outside the Competition period shall be void.

ENTRANTS
This Competition is open to employees of Travel Agencies (who have a valid BPA with Silversea) and are current members of Silversea Agent Rewards and have the permission of their employer to enter into the Competition and are residents of the United Kingdom aged 18 or over at the time of entry. Proof of eligibility must be provided upon request. If a winner is found to be ineligible, Promoter reserves the right to award the Prize to another entrant and to require the return of any part of the Prize already awarded.

Employees of Silversea Cruises or any of its Group Companies, subsidiaries, affiliates (including any relatives, family members, agents and/or household members) and anyone else connected with the operation or fulfilment of the Prize Draw (including third party promotional partners) and their respective associated, affiliated, or subsidiary companies, and their immediate families and household members of all such employees are expressly excluded from entering this Competition.

To enter the Competition, entrants must confirm a new booking on any Expedition cruise that has been named and fully deposited during the competition period.

There is no maximum number of entries per person. Bulk automatically generated or third party entries shall be void.

Entries must be received before the Competition end date. Late, incomplete, invalid and/or corrupt submissions will not be accepted and will be disqualified. No responsibility will be accepted by the Promoter for lost entries and proof of transmission will not be accepted as proof of receipt.

THE COMPETITION PRIZE (“Prize”)
The Prize consists of 9 x 500 Silversea Agent Rewards Points

SELECTION OF WINNERS
There shall be nine winners and the winners will be chosen at random from valid entries received before the Competition end date and notified by email or any other other contact details provided to the Promoter during the entry period, within seven (7) days of the draw.

The draw will take place within five (5) working days of the close of the Competition.

The winners will be required to confirm acceptance of Prize within seven (7) days of being notified. In the event that a winner declines the Prize, and/or is unable to accept the Prize, and or fails to respond to the Promoter’s email(s) within the required time frame and or does not receive the Promoter’s email for whatever reason, and/or does not respond to the Promoter’s email in the prescribed manner, and/or does not claim/take the Prize, and/or is ineligible or otherwise unable to claim the Prize, the winner shall forfeit the Prize and the Promoter shall have no liability to the winner and reserves the right in its absolute and sole discretion to award the Prize to another winner.

GENERAL TERMS AND CONDITIONS
By entering this Competition, entrants are considered to have agreed to these terms and conditions, as well as the privacy policies of Silversea Cruises https://www.silversea.com/privacy-policy.html.

The Prize(s) are subject to (i) these Prize terms and conditions and (ii) the Promoter’s standard booking terms and conditions that are available in the Silversea Cruises relevant brochure and at https://www.silversea.com/terms and conditions.html. The Promoter reserves the right to amend these terms and conditions and/or the booking terms and conditions at any time.

The winners must submit all the necessary documentation in the prescribed manner and by the prescribed dates, in order to receive their Prize. Failure to provide such documentation and/or information shall entitle the Promoter to withdraw the Prize and select another winner. Prize fulfilment will be managed by the Promoter.

The determination and decision of the Promoter on all matters shall be final and no correspondence or discussion will be entered into (including as to the winners).

The Promoter reserves the right, in its sole and absolute discretion, to:
(i) cancel, suspend and/or modify this Competition , or any part of it, if any fraud, technical failures, a change in applicable law or any other factor beyond the Promoter's reasonable control impairs the integrity and/or proper functioning of this Competition; (ii) In the event of a technical or other error resulting in there being more winners than the Prize (a) declare as void any claims or entries resulting from such technical or other error and/or (b) allocate the available prize through a further draw or to divide the value of the Prize between the winners of the Prize Draw and;
(iii) reject any submissions/entries, and/or disqualify any entrants, at any time, if it deems that there has been or may be, whether intended or otherwise, any: (a)breach of any of these terms and conditions; and/or (b) infringement or potential infringement of any third party rights and/or intellectual property; and/or (c) defamation or potential defamation of any persons, companies, intellectual property, institutions, cultures or similar; and/or (d) offence or potential offence caused, howsoever arising; and/or (e) breach of any laws, regulations, codes (including moral codes), uses, guidelines and generally accepted etiquette rules required from any internet users, platforms, providers, hosts and/or sites and similar.

The Prize is as described, is not transferable, cannot be amended once booked, has no cash value (and cannot be exchanged for cash) and cannot be re-sold.

The Promoter reserves the right, in its sole and absolute discretion, to change the Prize and/or substitute any or all of the Prize with an alternative prize of equivalent value.

The winner(s) may be requested to take part in publicity resulting from the prize draw. The Promoter (and its group companies) shall seek winners consent to use, in any way and/or through any medium, of any comments provided and/or made by the winning entrant including, without limitation, those provided by the winning entrant on any social media sites and/or Silversea Cruises owned marketing channels (including the Silversea Cruises website), for the benefit of promoting the Promoter and associated companies, subject to the applicable policies of the relevant social media sites and/or marketing channels and Silversea’s Privacy Policy a copy of which is linked below.

Subject to Silversea Cruises’ privacy policy and these terms and conditions, the winner(s) title, surname and county: (i) may be announced on the Silversea Cruises Facebook, Twitter and/or Instagram accounts, as well as on its blog and in other marketing material for a period of 6 months following the announcement of the winner of the Promotion; and (ii) can be obtained by sending a stamped addressed envelope to the Marketing Department, Silversea Cruises, 7 The Heights, Brooklands, Weybridge, Surrey, KT13 0XW, within 30 days of the Closing Date. By entering into the Promotion, the winner(s) agree to their details being shared for this purpose.

In entering the Competition, entrants agree not to post any detrimental content on any social media platform and/or in any other mediums.

Any personal information provided during the entry process (including but not limited to entrant’s name) must be valid and truthful. The Promoter accepts no responsibility or liability for any incorrect, false or fictitious personal information provided to it.

The Promoter shall use the entrants’ personal data for the purpose of administering and/or promoting this Competition.If entrants wish to receive marketing information from the Promoter, they can opt-in on the Promoter’s website, and can opt-out at any time by writing to the Promoter at the address below, or by clicking the link in any message received. By entering this Competition, each entrant is providing information to the Promoter who undertakes to process such entrant’s personal details in accordance with the Data Protection Legislation which shall mean in each case to the extent applicable to activities undertaken in connection with the Competition : (i) Regulation (EU) 2016/679; and (ii) UK GDPR (the “GDPR”) the GDPR as applicable as part of UK domestic law by virtue of section 3 of the European Union (Withdrawal) Act 2018 and as amended by the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 (as amended, Directive 2002/58/EC; and (iii) the California Consumer Privacy Act (the “CCPA”) and any other legislation and/or regulation implementing or made pursuant to them, or which amends, replaces, re-enacts or consolidates any of them, and all other applicable laws relating to processing of personal data, data protection and privacy that may exist in any relevant jurisdiction, including, where applicable, the guidance and codes of practice issued by supervisory authorities.

The entrant shall be liable for complying with any fiscal and/or tax requirements (including, without limitation, any benefit-in-kind declarations and/or calculations) and other legal obligations and/or requirements arising out of, or in connection with, the Prize.

Save where it has been negligent, Promoter will not be responsible or liable for (i) any loss (including without limitation, indirect, special or consequential loss or loss of profits), damage, cost, compensation and/or other expense which is suffered and/or sustained by any party or any personal injury or death occurring as a result of participants' entry into the Competition or their acceptance and/or use of the Prize, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit participant's ability to participate in the Competition. Nothing in these Terms and Conditions shall in any way limit Silversea Cruises' liability for death or personal injury caused by its negligence or for any other matter where liability may not be limited as a matter of law.

This Competition shall be subject to English law and the courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with this Competition.

 Travel Partner Appreciation Month Prize Draw 2023 (“Competition”) 

Terms & Conditions

These terms and conditions apply to the Silversea Cruises Competition to win 1x $500 USD Visa gift card.

1. Promoter

The Promoter of this Competition is Silversea Cruises Ltd, with its principal place of business at 1050 Caribbean Way, Miami, Florida, 33132, USA (referred to within these Terms and Conditions as “Silversea Cruises”).

2. The Prize (“Prize”)

Each of the 8 winners will each receive 1x $500 USD Visa Gift Card. 

It is a condition of entry that all winners must agree to take part in any and all activities determined by the Promoter including, without limitation, video filming and/or publicity relating to this competition.

3. Competition entry Period:

The Competition entry period commences at 09:00hrs SGT on 1^st of May 2023 and concludes at 23.59hrs SGT on 30^th of June 2023 (the “Closing Date”). Any entries received outside the Competition period shall be void.

4.    Entrants

1. The Competition is open to employees of Qualifying Travel Partners who are legal permanent residents of Taiwan, Japan, Singapore, Indonesia, Philippines, Thailand, and India and who:
   1. have reached the legal age of majority in their territory of residency prior the Competition Entry Period. Proof of eligibility must be provided upon request.
   2. Are not prohibited in any manner by any person, entity, authority, or law anywhere in the world from participating in this Promotion or any similar Promotion.
2. “Qualifying Travel Partner” means travel agents registered on my.silversea.com who shall be accredited travel agents in the territory where they are authorized by the Promoter to sell Qualifying Bookings. For the avoidance of doubt the Qualifying Travel Partners must hold the following accreditation(s) in their territory:
   • Taiwan – Tourism Bureau under the Ministry of Transportation and Communications
   • Japan - JATA and ANTA
   • Singapore – National Association of Travel Agents Singapore (NATAS)
   • Indonesia - ASSOCIATION OF THE INDONESIAN TOURS AND TRAVEL AGENCIES (ASITA)
   • Philippines - Philippine Travel Agencies Association (PTAA)
   • Thailand – Association of Thai Travel Agents (ATTA)
   • India - The Travel Agents Association of India (TAAI)
3. Promoter reserves the right to select/approve Qualifying Travel Partners
4. Qualifying Booking: shall mean an individual booking made by a Qualifying Travel Partner on any Expedition Cruise, regardless of the room category.  The booking must be confirmed, named, and fully deposited during the Competition Entry Period.
5. It is the sole responsibility of the Qualifying Travel Partner to ensure that the booking information is accurate.
6. Qualifying bookings must be active at the time of the Prize Redemption.
7. Qualifying Bookings shall be subject to verification and Sponsor’s determinations shall be final in its absolute discretion.
8. Employees of the Promoter and/or any of its Group Companies, subsidiaries, affiliates (including any relatives, family members and/or household members) and anyone else professionally associated with this Competition are expressly excluded from entering.
9. Only one entry per Qualifying Booking will be accepted.
10. Entries must be received before the Closing Date. Late, incomplete, invalid and/or corrupt submissions will not be accepted and will be disqualified. No responsibility will be accepted by the Promoter for lost entries and proof of transmission will not be accepted as proof of receipt.
11. It is a condition of entry that your employer consents to you participating in the Competition. By submitting an entry, you confirm that your employer has no objection to you entering this Competition.
12. Winner(s) must be an Employee of a Qualifying Travel Partner on the date of the prize redemption.

5.   Selection of Winner(s)

1. The winner(s) will be chosen at random from valid entries received before the Closing Date in the presence of an independent scrutineer.  
2. There will be one prize drawn every week on the following dates: 12, 19, 26 May 2023, 2, 9, 16,23, 30 June 2023.
3. The winner(s) will be notified by email (to the email provided as part of their entry) within 2 business days of the draw. 
4. The winning email notification will include instructions on how/by when the winner(s) are to claim their Prize. Failure to claim and/or provide such details within the required time frame may result in forfeiture of the Prize.
5. In the event that a winner declines the Prize, and/or is unable to take the Prize, and/or fails to respond to the Promoter’s email(s) within the required time frame and/or does not receive the Promoter’s email for whatever reason, and/or does not respond to the Promoter’s email in the prescribed manner, and/or does not claim/take the Prize, and/or is ineligible or otherwise unable to claim the Prize, the winner shall forfeit the Prize and the Promoter shall have no liability to the winner and reserves the right in its absolute and sole discretion to select another winner.

Insofar as is permitted by law, the Promoter, its employees, agents, subcontractors and/or or distributors will not in any circumstances be responsible or liable for: (i) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), damage, cost, compensation and/or other expense which is suffered and/or sustained by any party (whether or not arising from any person’s negligence) in connection with this Competition and/or in accepting and/or using the Prize and/or (ii) any personal injury or death occurring as a result of taking up/accepting the Prize, except where it is caused by the negligence of the Promoter and/or , its employees and, where it is responsible for them, its  agents and/or distributors. The winner(s)’s statutory rights shall not be affected. 
13. The winner(s) shall be liable for complying with any fiscal and/or tax requirements (including, without limitation, any benefit-in-kind declarations and/or calculations) and other legal obligations and/or requirements arising out of, or in connection with, the Prize.

The winner(s) shall be responsible for informing themselves as to the terms and conditions of the gift card/voucher, which may include (without limitation) a gift card ‘use by’ and/or validity date, restrictions and/or limitations of use and/or limitations of liability (e.g., for loss). Gift card terms and conditions are determined solely by Visa.
    and the Promoter shall carry no liability in respect to the same.
15. All federal, estate, provincial, and local laws and regulations apply. This Competition is Void where prohibited.

4. Qualifying Booking: shall mean an individual booking made by a Qualifying Travel Partner on any Expedition Cruise, regardless of the room category.  The booking must be confirmed, named, and fully deposited during the Competition Entry Period.

   (ii) reject any entries and/or disqualify any entrants, at any time, if the Promoter in its sole and absolute discretion deems that there has been or may be, whether intended or otherwise, any: (a) breach of any of these terms and conditions; and/or (b) infringement or potential infringement of any third party rights and/or intellectual property; and/or (c) defamation or potential defamation of any persons, companies, intellectual property, institutions, cultures or similar; and/or (d) offence or potential offence caused, howsoever arising; and/or (e) breach of any laws, regulations, codes (including moral codes), uses, guidelines and/or any other generally accepted etiquette rules required (without limitation) from any internet users, platforms, providers, hosts and/or sites and/or similar.
5. The Prize is as described, is not transferable, cannot be amended or varied, has no cash value (and cannot be exchanged for cash) and cannot be re-sold. 
6. The Promoter reserves the right, in its sole and absolute discretion, to change the Prize and/or substitute any or all of the Prize with an alternative Prize of equivalent value. 
7. The winner(s) may be required to take part in publicity resulting from the Competition. The Promoter (and its Group Companies) shall be entitled to make use, in any way and/or through any medium, of any comments provided and/or made by the winner(s) including, without limitation, those provided by the winner(s) on any social media sites and/or Silversea Cruises  owned marketing channels (including the Silversea Cruises website), for the benefit of promoting the Promoter and its Group and/or associated companies, subject to the applicable policies of the relevant social media sites and/or marketing channels. 
8. In entering the Competition, entrants agree not to post any detrimental content on any social media platform and/or in any other mediums.
9. The determination and decision of the Promoter on all matters shall be final and no correspondence or discussion will be entered into (including as to the winner(s)). 
10. The Promoter reserves the right in its reasonable discretion to: (i) disqualify any entrant, claimant, competitor or their guest whose conduct is contrary to the spirit of the rules or the intention of the Competition and to declare as void any or all of their claims or entries based on such conduct; (ii) declare as void any claims or entries resulting from any printing, production and/or distribution errors (including without limitation any error(s) on any website and/or app of the Promoter and/or in any published  materials, regardless of format) and/or where there have been error(s) in any aspect of the preparation for or conduct of the Competition that materially affects the result of the Competition and/or the number of entrants, claimants and/or the value of claims; (iii) add to or waiver any rules and/or terms and conditions at any time; and/or (iv) cancel the Competition or any part of it, at any stage, in the event of circumstances beyond the Promoter’s reasonable control.
11. The Promoter reserves the right to cancel, suspend and/or amend/modify this Competition and/or the Prize, or any part of it and at any time, if any fraud, technical failures, change in applicable law(s) or any other factor beyond the Promoter's reasonable control impairs the integrity or proper functioning of the Competition, as determined by Promoter in its sole and absolute discretion. 
12. Insofar as is permitted by law, the Promoter, its employees, agents, subcontractors and/or or distributors will not in any circumstances be responsible or liable for: (i) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), damage, cost, compensation and/or other expense which is suffered and/or sustained by any party (whether or not arising from any person’s negligence) in connection with this Competition and/or in accepting and/or using the Prize [and/or its contents and/or their ingredients]; and/or (ii) any personal injury or death occurring as a result of taking up/accepting the Prize, except where it is caused by the negligence of the Promoter and/or , its employees and, where it is responsible for them, its  agents and/or distributors. The winner(s)’s statutory rights shall not be affected. 
13. The winner(s) shall be liable for complying with any fiscal and/or tax requirements (including, without limitation, any benefit-in-kind declarations and/or calculations) and other legal obligations and/or requirements arising out of, or in connection with, the Prize.
14. The winner(s) shall be responsible for informing themselves as to the terms and conditions of the gift card/voucher, which may include (without limitation) a gift card ‘use by’ and/or validity date, restrictions and/or limitations of use and/or limitations of liability (e.g., for loss). Gift card terms and conditions are determined solely by Visa and the Promoter shall carry no liability in respect to the same.
15. This Competition shall be governed by Australian law and the exclusive jurisdiction of the courts of Australia.

7. Personal Data

1. Any personal information and/or data provided during the entry process (including, without limitation, the entrant’s name) must be valid, up to date and truthful. The Promoter accepts no responsibility or liability for any incorrect, false or fictitious personal information provided to it.
2. The Promoter shall use the entrants’ personal data (Full name, email address, Phone number, Travel Agency, address) for the purpose of administering and/or promoting this Competition. If entrants wish to receive marketing information from the Promoter, they can opt-in on the Promoter’s website and can opt-out at any time by writing to the Promoter at the address below, or by clicking the unsubscribe link in any message received. 3. By entering this Competition, each entrant is providing information to the Promoter who undertakes to process such entrant’s personal details in accordance with the Data Protection Legislation which shall mean in each case to the extent applicable to activities undertaken in connection with the Competition: (i) Regulation (EU) 2016/679; and (ii) UK GDPR (the “GDPR”) the GDPR as applicable as part of UK domestic law by virtue of section 3 of the European Union (Withdrawal) Act 2018 and as amended by the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 (as amended, Directive 2002/58/EC; and (iii) the California Consumer Privacy Act (the “CCPA”) and any other legislation and/or regulation implementing or made pursuant to them, or which amends, replaces, re-enacts or consolidates any of them, and all other applicable laws relating to processing of personal data, data protection and privacy that may exist in any relevant jurisdiction, including, where applicable, the guidance and codes of practice issued by supervisory authorities.
4. Subject to Silversea Cruises’ privacy policy and these terms and conditions, the winner(s) title, surname and county/province: (i) may be announced on the Silversea Cruises Facebook, Twitter and/or Instagram accounts, as well as on its blog and in other marketing material for a period of 6 months following the announcement of the winner of the Competition; and (ii) can be obtained by sending a stamped addressed envelope to the Marketing Department,  Silversea Cruises , 15/101 Miller Street, Sydney 2060, within 30 days of the Closing Date. By entering into the Competition, the winner(s) agree to their details being shared for this purpose.

Conditions of entry of the prize draw "Travel Advisor Appreciation Month"

Participation in the prize draw of Silversea Cruises UK Ltd, hereinafter referred to as operator or organiser, is free of charge and exclusively governed by these conditions of entry. By entering the competition you agree to be bound by these terms and conditions ("Terms and Conditions"). Information published in connection with this Competition, including any such information about the opportunity to enter the Competition published in Silversea Cruises' publications (including social

media, if applicable), applies to this Competition. In the event of any conflict between provisions referred to in such publications and these Terms and Conditions, these Terms and Conditions shall expressly prevail.

Participation

Agents who book a Silversea expedition cruise during the promotion period will be entered into a draw to win a €500 gift voucher. Bookings made after the closing date will not be considered for the prize draw. Participation in the competition is free of charge.

Eligible participants

Natural persons who are resident in Europe and have reached the age of 18 are eligible to participate. The consent of the travel agency owner is required for participation in the competition. All persons involved in the conception and implementation of the competition and employees of Silversea Cruises as well as their family members are not eligible to participate in the competition. In addition, Silversea Cruises reserves the right, at its sole discretion, to exclude any person from participation if there are reasonable grounds for doing so, for example

(a) in the event of manipulation in connection with access to or implementation of the competition, (b) in the event of breaches of these terms and conditions of entry, (c) in the event of dishonest action or (d) in the event of false or misleading (d) in the event of false or misleading information in connection with participation in the competition.

Prize determination & entry period

The duration of the competition is as follows: 01 May 2023 to 30 June 2023 at 23:59. During this period, a € 500 DKV fuel voucher will be drawn at random every week.

In the event that Silversea Cruises is unable to award the prize as described in these Terms and Conditions for reasons beyond Silversea Cruises' control, Silversea Cruises reserves the right to award a prize of a similar nature and value or, at its discretion, the cash value of the prize.

Winners will be determined after the closing date by a random draw from among all entrants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw.

The winners of the raffle will be informed of their winnings promptly by e-mail. The prize will only be handed over to the winner. An exchange or cash payment of the prize is not possible.

Silversea Cruises will bear any costs incurred for the shipment of the prize. Any additional costs associated with claiming the prize will be borne by the winner. The winner is responsible for any taxation of the prize.

If the winner does not respond within a period of 5 days after being notified to his or her registered email address, the prize may be transferred to another participant through a new draw.

Termination of the competition

Silversea Cruises expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.

Data protection

Participation in the competition requires the provision of personal data. The participant assures that the personal information provided by him/her, in particular first name, surname and email address, is true and correct. Silversea Cruises points out that all personal data of the participant will neither be passed on to third parties nor made available to them for use without the participant's consent. All personal data will only be used for the purpose of the competition.

In the event of a win, the winner expressly agrees to the publication of his/her name and place of residence in the advertising media used by the Organiser. This includes the announcement of the winner on the website of the operator and its social media platforms.

The participant may revoke his/her declared consent at any time. The revocation must be sent in

writing to Silversea Cruises. After revocation of consent, the participant's personal data collected and stored will be deleted immediately.

When entering the competition, entrants will be given the opportunity to consent to receive marketing materials from Silversea Cruises by email. If you consent, your data will be processed in accordance with our privacy policy (see https://www.silversea.com/privacy-policy.html for more details). Please note that you can unsubscribe from the newsletter at any time. In addition, you can also stop receiving further promotional emails by simply sending an objection to the sender.

Raffle operator

The competition operator is RCL Cruises Ltd - trading here as Silversea Cruises (UK) Ltd (company number 07366612), a company registered in Germany with its registered office at Amelia-Mary- Erhart-Strasse 8, 1st floor, 60549 Frankfurt am Main.

Applicable law

Questions or complaints in connection with the competition must be addressed to the operator. The operator's competition is subject exclusively to the law of the European Union. The legal process is excluded. Silversea Cruises reserves the right to change these terms and conditions. Any changes will be published on the Silversea Cruises website, www.silversea.com.

Severability clause

Should any provision of these Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Conditions of Participation. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Conditions of Participation.
